Public Records
Environmental Resources Management is governed by The Public Records Act Chapter 119, Florida Statutes. Therefore, the records kept by Environmental Resources Management are open for public inspection and copying. The Records Management Section is the central storage and processing area for department records, and assists customers in locating, viewing and copying those records. Records for various programs can include, but not be limited to inspection reports, permit records, enforcement actions, contamination records, environmental monitoring records, contract records and project information.
Viewing public records
You can view most Environmental Resources Management Public Records at the main office located at the Overtown Transit Village-North.
Additionally, select Public Records are available online. The records available for viewing online contain recent information for environmental permitting and regulatory programs.
Certain frequently-requested lists are available in spreadsheet format at our FTP (File Transfer Protocol) site. These include lists of permitted facilities, contaminated sites, enforcement cases, and NPDES data and are available at FTP Lists.
In the office
Contact the Records Management Section if you want to request public records at the main office. In order to locate a record, you will need to provide one or more of the following: Facility or location name, street address, folio number, Environmental Resources Management or DEP permit number, file number, or facility ID number.
When requesting public records, there are two types of records searches that can be performed:
- Standard records search
Staff from the Records Management Section will review department databases and files for information and documents related to the request. Standard Records Searches typically take one or two days to prepare. - Environmental Resources Management-wide records search
Representatives from each workgroup within Environmental Resources Management will review the request and search their respective paper and electronic records. The records from all workgroups will be compiled for the customer to review. Because a records search involves multiple staff and significant effort, applicable fees may be charged pursuant to the provisions of Chapter 119 F.S. A records search typically takes a week to 10 days to prepare.
Copying
Paper copies of records can be provided at 15 cents per single-sided page and 20 cents per double-sided page. Copies of electronic records can be provided on compact disc at a minimal cost. Documents found in the online records search can be printed for free.
Appointments
If you wish to review a record at the main office, then scheduling an appointment is suggested, but not required. If you wish to review a record without an appointment, there may be a wait depending on the availability of the record and the number of customers requesting documents at the time. Scheduling an appointment will allow staff adequate time to research and retrieve the records for your request and have them available for you at your scheduled time.

Environmental status reviews
Another option for obtaining information is to request an Environmental Status Review (ESR). When an ESR is requested for a specific property, staff from the Enforcement Section will coordinate and compile all environmental information on said property from the individual sections in Environmental Resources Management.
An employee will also conduct an environmental site inspection of the property. Environmental Resources Management will then send a letter providing you with the information obtained from all sections along with the results of the on-site inspection. This process takes approximately three to four weeks and a charge of $1,200 per folio is applied.
