Rules of Miami-Dade County Auctions
-
Sale will be to the highest bidder. The bidding is open, competitive and progressive. You must be 18 years of age or older to bid on, or purchase a vehicle. Internal Services Department employees, their families, and agents acting on the employees' behalf are not eligible to bid on County-owned vehicles. Any changes to the listing of sale vehicles will be announced at the auction.
-
All property is sold “As is—Where is” with no guarantee, written, express or otherwise. No representation is made as to the equipment present on any vehicle. Bidders should inspect the vehicles in which they have an interest and satisfy themselves as to the condition and value of the vehicles before bidding on them because ALL SALES ARE FINAL AND THERE ARE NO REFUNDS. A bidder’s failure to make such an inspection is not grounds for the cancellation of a sale, nor does it entitle the bidder to a refund of the purchase price paid or any portion thereof. Bidders must understand that, by the act of bidding for a vehicle, they accept the rules of the auction and the fact that the vehicles are being sold exactly as presented for sale on the day of the auction, with all faults, whether revealed or not. Further, those who bid, by their voluntary participation in the auction, accept that: (1) all sales are final, (2) no refunds will be made, and (3) any information which may be contained in County records pertaining to any vehicle or vehicles offered for sale shall not alter the legally binding contractual obligation voluntarily entered upon by them if they are selected as a high bidder. Vehicles which were used as police vehicles have been designated as such by asterisk (*) on the sale list. Spare tires may or may not be included with vehicle.
-
The Auctioneer’s decision is final as to who is the high bidder. The County reserves the right to reject any or all bids and to remove or re-offer any items listed for sale.
-
If the Auctioneer designates you as an item high bidder, you will have entered into a verbal contract to buy the vehicle. You must immediately come forward and sign a Bid Receipt Form, acknowledging your bid. When you bid, make sure that the vehicle you want to purchase is the actual vehicle being auctioned. If you are a high bidder for one or more than one vehicle, you must either make payment in full or pay a deposit of $200.00 for each vehicle. If you fail to make either payment in full or a $200 deposit for each vehicle for which you have been designated high bidder, Miami-Dade County may reject any or all of your high bids and decline to sell any or all of said vehicles to you.
-
New Terms of Sale: NO CASH.
-
--Payments may be made by Cashier's Check (made payable to "Board of County Commissioners"), or the buyer's MasterCard, or Visa. NO CASH and no other forms of payment will be accepted. Payment of the Balance Due on any vehicle will only be accepted at 2225 NW 72nd Avenue, Miami, Florida, between the hours of 8:00 a.m. and 3:00 p.m., on the Monday through Tuesday immediately after the auction. No payment will be accepted after the balance due deadline has passed.
-
You will be given the vehicle title when you complete payment. The title will only be assigned to the identical name that you designate on the Bid Receipt Form. Be sure that the name you provide on the Bid Receipt Form is accurate because it will be used to establish the “Purchaser” for vehicle title transfer with no exceptions.
-
Notice to Dealers: Motor Vehicle Dealers operating under the provisions of Chapter 320, Florida Statutes, must present a copy of their Florida Dealer’s License to the Auction Manager prior to the start of the Auction in order that the vehicle sales price is not entered onto the Certificate of Title (Florida Statute 319.22[4]). Dealers are encouraged to ensure that a current copy of their Motor Vehicle Dealer’s License is on file with Materials Management Division, or to provide a copy prior to the auction start, to allow Miami-Dade County to utilize the provisions of Chapter 319.22(4), Florida Statutes, in the title transfer process.
-
Vehicles to be auctioned that are parked along the fence and which are marked with the white letters “NR” on the windshield are non-operational and do not run. Substantial repairs may be required to make these vehicles operational. Vehicles marked as “CD” are “Certificate of Destruction” vehicles, which under Florida law may not be reregistered for operation in the State of Florida. They are for sale for their value as a source of parts. Only persons age 18 and over may enter into the areas where NR and CD vehicles are parked. Buyers inspecting these vehicles should exercise extreme caution as these vehicles may present hazards due to broken glass, exposed sharp metal edges, damaged or defective components or systems, or other faults, visible or not visible. Miami-Dade County will not be responsible for any injuries suffered by any individuals while they are inspecting NR or CD vehicles. You enter the area in which these vehicles are parked at your own risk.
-
You must remove your vehicle immediately after full payment. Removal of vehicles is restricted to 7:00 a.m. to 2:00 p.m. Monday-Wednesday immediately after the auction. Vehicles must be removed by the Wednesday following the sale. Show the vehicle title and the “Paid in Full” Official County Receipt to shop personnel to obtain your vehicle. The County will not be responsible for loss or damage to the vehicles after they are sold as evidenced by the assignment of title. Vehicles not removed from the auction site after a period of one week from the deadline for payment in full will be considered as abandoned property and turned over to the Public Works Department for disposal.
-
If you hire a tow truck to remove your vehicle, the driver must have a copy of the “Paid in Full” Official County Receipt and a copy of the title in order for the vehicle to be released for removal.
